What is Statement of claim (petição inicial)?

A statement of claim is the pleading that opens the labor lawsuit. In it the claimant narrates the employment relationship, describes the facts and frames each claim. Since the 2017 Labor Reform (art. 840, §1º, of the CLT), every claim must be specific, determinate and stated with a value — which turned the pleading into a quantified document.

It defines the object of the dispute and therefore the ceiling of the exposure. Everything the defense must address originates here: reading the pleading precisely is the first step of any strategy.
