What is Appeal deposit (depósito recursal)?

An appeal deposit is the security required to appeal monetary convictions (art. 899 of the CLT). It has a per-appeal ceiling (adjusted annually) and, once the conviction amount is reached, no further deposit is required (Súmula 128 of the TST). After the Reform, it is halved for micro and small companies and waived for some entities.

It is a capital cost: appealing ties up cash until the judgment becomes final.
