Court approval of settlement is the judicial seal on a conciliation. Once the agreement is approved, the conciliation term has the force of an unappealable decision for the parties (art. 831, sole paragraph, of the CLT) and constitutes an enforceable title: if breached, it is enforced directly. It is what turns a negotiation into an exigible obligation.
Settlement is one of the main exits from labor litigation and, in a significant share of cases, ends the dispute before a merits judgment. Deciding when to settle — and for how much — is an economic choice, not merely a legal one.
