What is Claim granted (procedência)?

A granted claim is the judge upholding the request (art. 487, I, of the CPC): once the right is recognized, the company is, as a rule, convicted to pay the corresponding award. It is the most relevant merits outcome for measuring risk, because it turns the amount claimed into an actual obligation.

Granting is rarely uniform: it varies by claim type, by court and by judge. Across real Labor Court merits decisions, claims are upheld — fully or partially — in roughly two thirds of cases. Knowing which claims tend to be granted is what separates a blind defense from a selective one.
