What is Claimant (reclamante)?

The claimant is the party who brings the labor lawsuit. As a rule the employee or former employee, they occupy the plaintiff side and frame, in the statement of claim, the claims that delimit the dispute (arts. 839 and 840 of the CLT). It is from their narrative and their claims that the entire risk analysis begins.
The claimant’s identity matters beyond the isolated case: the litigation history of the same worker is a relevant element in assessing predatory litigation and in reading the portfolio.
