What is Reinstatement (reintegração)?

Reinstatement is the employee’s return to their post, with the salaries of the period away. It lies where a dismissal is void for breaching a form of job security — pregnancy, occupational, union-officer — or a guarantee of employment (art. 495 of the CLT). The effect is twofold: the company takes the employee back and bears the gap between dismissal and return.
If the protected period has already expired by the time of judgment, reinstatement converts into an equivalent indemnity (Súmula 396 of the TST). The risk therefore grows with the length of the proceedings.
