What is Union as procedural substitute (substituição processual)?

Also: substituição processual · ação coletiva sindical · union substitution

Procedural substitution is the union litigating, in its own name, for an entire category. Authorized by the Constitution (art. 8º, III), the union defends the workers’ homogeneous individual rights without each one having to join the action. A favorable result benefits all those represented.

These actions concentrate, in a single case, claims that affect dozens or hundreds of employees — which multiplies the exposure and calls for treatment distinct from individual litigation.

How LABORIS AI uses it

LABORIS AI recognizes the collective nature of these actions and sizes the reach of the claim across the affected group of workers, avoiding underestimating a liability that, though in a single case, projects across an entire category.
