What is Labor hearing (audiência trabalhista)?

A labor hearing is the meeting of the parties before the judge. It may be unified — concentrating conciliation, defense and evidence in a single act, typical of summary procedure —, initial, evidentiary (testimony and witnesses) or for judgment (arts. 843 and 849 of the CLT). It is where conciliation is attempted and where the preposto represents the company.

The hearing is the densest point of the case: appearance, oral evidence and settlement offers concentrate there. For the company, failing to appear at the inaugural hearing may result in default.
