What is Company representative at hearing (preposto)?

A preposto is the person who appears at a hearing on behalf of the defendant company. Their statements about the facts bind the employer (art. 843, §1º, of the CLT): what the preposto admits, the company admits. Since the 2017 Labor Reform (art. 843, §3º), the preposto need not be the company’s employee, relaxing the rule of Súmula 377 of the TST.

They are credentialed by the letter of representation (carta de preposição). Preparing the preposto is a sensitive part of the defense: an inattentive statement can, on its own, compromise well-built arguments in the statement of defense.
