What is Dismissal for cause (justa causa)?

Also: justa causa · dismissal for cause · dismissal for serious fault

Dismissal for cause is dismissal for a serious fault by the employee. The list is exhaustive (art. 482 of the CLT): dishonesty, misconduct, indiscipline, insubordination, job abandonment, drunkenness, acts against honor, among others. Once recognized, the employee loses prior notice, proportional 13th and vacation, the 40% penalty and unemployment insurance.

It requires robust proof, immediacy and proportionality — and there can be no double punishment for the same fact.

How LABORIS AI uses it

LABORIS AI assesses the support for dismissal for cause by the evidence and the court’s pattern, measuring the risk of reversal into a dismissal without cause.
