What is Employment relationship (vínculo empregatício)?

An employment relationship is recognized when the four requirements are present: personal performance, subordination, payment and non-occasional work (arts. 2º and 3º of the CLT). It is disputed in arrangements such as contractor-firm hiring (“pejotização”), self-employment, internships and outsourcing.

Once the relationship is recognized, all the awards for the period open up — which makes it a high-impact claim on the liability.
